1. Acceptance of Terms

By accessing or using AI Photo Factory ("Service"), operated by LNX Cloud Technology, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

These Terms apply to all visitors, users, and others who access or use the Service, including our website at aiphotofactoryapp.com and our mobile applications.

2. Description of Service

AI Photo Factory provides AI-powered photo generation tools including:

• AI Couple Photo Generator — creates romantic couple portraits from uploaded photos
• AI Headshot Generator — creates professional headshots from selfies
• AI Dress Up Generator — applies virtual outfit transformations to photos
• AI Baby Photo Generator — creates baby portraits from parent or baby photos

The Service operates on a credit/coin-based system. You purchase credits to generate AI images. Credits are non-refundable once used.

3. User Accounts

To access certain features, you may need to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete registration information
• Notifying us immediately of any unauthorized use of your account

You must be at least 13 years old (or 16 in the EEA) to create an account. By creating an account, you represent that you meet this age requirement.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You must NOT:

• Upload photos of individuals without their explicit consent
• Generate images that are defamatory, harassing, or harmful to any person
• Create non-consensual intimate imagery (NCII) or deepfakes intended to harm
• Upload photos of minors for any purpose other than creating innocent, family-appropriate portraits with parental consent
• Use the Service to generate content that violates any applicable law
• Attempt to reverse-engineer, decompile, or extract our AI models
• Use automated tools to scrape, crawl, or bulk-generate images
• Resell or redistribute generated images as your own AI service
• Upload photos containing illegal content
• Impersonate any person or entity

5. Intellectual Property

5.1 Your Content

You retain ownership of the photos you upload. By uploading photos, you grant us a limited, temporary license to process them solely for generating your requested AI output. This license terminates when your uploaded photo is deleted from our servers (immediately after generation).

5.2 Generated Images

AI-generated images created using your uploaded photos are provided to you for personal and commercial use, subject to these Terms. You may use generated images for social media, printing, personal projects, and commercial purposes. You may not claim that AI-generated images are unaltered photographs of real people.

5.3 Our Intellectual Property

The Service, including our AI models, templates, software, and website content, is owned by LNX Cloud Technology and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary technology.

6. Payments and Credits

• Credits are purchased through the mobile app via Google Play or Apple App Store in-app purchases
• All purchases are final. Credits are non-refundable once purchased, except as required by applicable law
• Prices are subject to change with notice
• We are not responsible for failed generations due to poor-quality uploaded photos
• Refund requests for technical failures will be reviewed on a case-by-case basis

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• AI-generated results will meet your specific expectations
• The Service will be available in all geographic locations

AI-generated images are artistic interpretations and may not accurately represent real people, places, or events. Do not use generated images to misrepresent facts or deceive others.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LNX CLOUD TECHNOLOGY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, without prior notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
